Les services proposés par ReversePro.io sont immatériels et accessibles immédiatement après validation de la commande. Ainsi :

• Les présentes Conditions Générales de Vente (CGV) constituent un contrat juridiquement contraignant entre ReversePro.io et l’utilisateur, accepté irrévocablement lors de la validation de la commande.
• Conformément à l’article L221-28 du Code de la consommation, le droit de rétractation est exclu pour les services numériques exécutés avec l’accord préalable de l’utilisateur.
• L’acceptation des CGV est formalisée par la validation de la commande et la case à cocher prévue à cet effet, laquelle constitue une signature électronique au sens de l’article 1369-5 du Code civil, ayant la même valeur légale qu’une signature manuscrite.
• Le paiement donne droit à l’accès aux services proposés mais ne garantit pas un résultat final, celui-ci étant soumis à des facteurs externes détaillés ci-dessous.

La localisation est obtenue uniquement si :

• Le destinataire reçoit le SMS et donne son consentement explicite en cliquant sur le lien sécurisé transmis.
• Le téléphone du destinataire est actif (connecté au réseau et avec la fonction de géolocalisation activée).

Limites du service

L’utilisateur reconnaît que :

• La localisation est ponctuelle et valable uniquement au moment où le destinataire donne son consentement.
• ReversePro.io ne garantit pas l’obtention de la localisation en cas de :
  • Téléphone éteint ou hors réseau.
  • Refus de consentement du destinataire.

Aucun remboursement ne sera accordé en cas d’échec lié à ces conditions.

3.2.2. Service d’Annuaire Inversé

Le service d’annuaire inversé ReversePro.io permet d’obtenir des informations publiques sur le titulaire d’un numéro de téléphone.

• L’absence de réponse ne peuvent engager la responsabilité de ReversePro.io et ne donnent droit à aucun remboursement.

ReversePro.io offers a service leveraging Open Source Intelligence (OSINT) technologies, allowing users to perform real-time searches across publicly available sources.

• ReversePro.io acts solely as a technical intermediary and does not control the content of the retrieved information.
• No data obtained via the service is stored, recorded, or altered by ReversePro.io after the user’s query.
• ReversePro.io does not create, modify, or manipulate the collected data in any way.

3.3. GDPR Compliance and Absence of Sensitive Data Processing

• ReversePro.io strictly adheres to GDPR principles, including data minimization and purpose limitation (Regulation EU 2016/679).
• No sensitive data (e.g., ethnicity, religion, health, political opinions) is processed by ReversePro.io (Article 9 of the GDPR).
• ReversePro.io does not collect, store, or modify personal data; only publicly accessible information that is lawfully available is displayed.
• Data updates and deletion requests must be directed to third-party sources, as ReversePro.io has no control over the presence, accuracy, or removal of such information.

3.4. User Responsibility and Authorized Data Usage

The user is solely responsible for how they use the information obtained via ReversePro.io and agrees to comply with applicable laws.

The following uses of the retrieved data are strictly prohibited:

• Harassment, threats, or intimidation against any individual.
• Identity theft, fraud, deception, or impersonation.

ReversePro.io shall not be held liable for any consequences arising from the user’s misuse of the retrieved data.

The user agrees to indemnify ReversePro.io against any legal claims, complaints, or lawsuits resulting from their use of the services.

If a user is found to be in violation of these Terms and Conditions, ReversePro.io reserves the right to suspend or terminate access to services without compensation or refund.

4. Registration and Account Creation

4.1.b Obligation to Provide Accurate Information

Required Information at Registration

When registering for the service, the User must provide accurate and up-to-date information, including:

• A valid email address.
• A secure password.

When creating their customer account, the User agrees to provide accurate, complete, and up-to-date information, particularly regarding their email address. This email address serves as the primary communication channel between ReversePro and the User and is essential for:

• Receiving login credentials and the password required to access the account;
• Confirmation of the subscribed membership and delivery of associated contractual information;
• Receiving reminders regarding the subscription and instructions on how to cancel it.

4.1.c Consequences of Providing an Incorrect Email Address

The User acknowledges and agrees that ReversePro shall not be held liable in the following circumstances:

• Failure to receive confirmation emails, login credentials, or subscription management communications due to an error in the email address provided during registration;
• Inability to receive communications due to issues related to the User’s email service (e.g., full inbox, spam filtering, automatic deletion, etc.).

4.1.d Access to Services and Subscription Management

The User is informed that they may access their account at any time using the login credentials provided during registration. This account allows the User to review subscription details and submit a cancellation request if necessary. Failure to receive emails shall not, under any circumstances, constitute grounds for a claim or refund request.

4.1.e User’s Duty of Diligence

The User is responsible for regularly checking their email inbox, including spam or junk mail folders, to ensure receipt of emails sent by ReversePro. If the User experiences difficulties accessing their account, they are encouraged to contact customer support using the communication channels available on the website.

The User acknowledges that the provided information is essential for accessing the services and agrees to keep it updated throughout the use of the platform.

4.2. Responsibility for Information and Access Security

The user guarantees the accuracy and truthfulness of the information provided during registration. Any false declaration will result in the suspension or termination of access to the services without prior notice or refund.

Registration is strictly reserved for individuals of legal age who have the full legal capacity to enter into these TCS.

The user is solely responsible for maintaining the confidentiality of their login credentials (email address and password). Any unauthorized use of the credentials is the sole responsibility of the user.

Transmission or Sharing of Access:

The transmission, assignment, or sharing of login credentials with third parties without prior written consent from ReversePro.io is strictly prohibited. In case of non-compliance, ReversePro.io reserves the right to suspend or terminate access to the services without refund.

In the event of abusive, diverted, or non-compliant behavior with these TCS, ReversePro.io reserves the right to:

• Suspend or terminate the user’s account without prior notice;

5. Payment and Subscription

5.1. Pricing and Payment Terms

Upon registration, the client benefits from a 48-hour trial period at a preferential rate of €0.90 , providing access to all the features of ReversePro. This amount is charged immediately upon account creation.

At the end of the trial period, if no cancellation has been made by the client before the end of the 48 hours, a monthly subscription of €49.50 or €29.90, depending on the chosen plan, is automatically activated.

The subscription fee is then automatically charged each month on the anniversary date of the subscription, unless the client cancels the subscription beforehand.

Recurring payments are made via the credit card used during registration.

5.1.1. Express Consent to Automatic Renewal

By accepting these Terms and Conditions of Sale (TCS) and finalizing the subscription, the client:

• Acknowledges being informed of the existence of the automatic renewal of the subscription after the trial period;
• Gives explicit consent for the authorization of recurring monthly charges by ReversePro.io on the credit card associated with their account.

This consent is confirmed by checking the mandatory box during registration, located before payment confirmation.

5.1.2. Failed or Refused Payments

In case of a failed payment (insufficient funds, expired card, etc.):

• ReversePro.io reserves the right to suspend access to the services until the payment is regularized;
• The client will be invited to update their payment information to reactivate access;
• After several unsuccessful attempts, ReversePro.io may proceed with the automatic termination of the subscription.

5.1.3. Taxes and Currencies

The prices indicated on the website are expressed in euros (€) and include the Value Added Tax (VAT) applicable on the day of the order.

Any change in the VAT rate will be automatically reflected in the service price.

5.1.4. Payment Security

Payments made on the site are secured through an authorized payment service provider.

Client banking information is never stored by ReversePro.io.

The user is responsible for ensuring that their banking information is valid and up-to-date to avoid any payment failure.

5.1.5. Fraud, Payment Security, and Client Responsibility

The client is solely responsible for the security and use of their banking information. By subscribing and accepting these TCS, the user acknowledges that:

• Recurring payments authorized by ReversePro.io are legitimate and authorized;

ReversePro offers three subscription plans, following a 48-hour trial period:

• Subscription at €49.50 per month: provides unlimited access to the following services:

  • Access to detailed data available through our platform
  • Priority support
• Subscription at €39.80 per month: provides access to the following services:

  Payment terms: This subscription is billed in two installments of €19.90 each, charged every two weeks.

  • Reverse phone number lookup, limited to 30 searches per month
  • Access to detailed data available through our platform
  • Priority support when needed

The ReversePro €29.90 subscription, activated after the 48-hour trial period, provides access to the following services:

• Reverse phone number lookup, limited to 15 searches per month
• Access to detailed data available through our platform
• Priority support when needed

Subscriptions are billed on a monthly basis and renew automatically unless canceled by the customer. Customers can manage their subscription at any time through their personal account and cancel it in just a few clicks, with no additional fees.

5.3 Modification of Subscription Fees and Plans

ReversePro reserves the right to modify the pricing conditions of its subscriptions to ensure the sustainability and optimization of its services, as well as the efficient management of payments.

These modifications may concern the amount of subscription fees, the billing frequency, and the payment terms, including the pricing structure applied to subscriptions.

Any modification will be made in strict compliance with the contractual commitments in force and will not compromise subscribers' access to the services they have subscribed to.

5.3.2 Reduction or Adjustment of Subscription Fees

ReversePro reserves the right, at its sole discretion, to reduce subscription fees or introduce occasional promotional offers. These adjustments may be applied either generally or selectively, based on commercial criteria determined by ReversePro.

Any modification aimed at reducing subscription costs will be implemented in the best interests of subscribers and as part of the continuous improvement of the service, without compromising the financial balance and sustainability of the offering.

5.3.3 Terms and Notification of Modifications

ReversePro may modify its pricing plans and billing terms to ensure service continuity and prevent any interruptions due to operational or banking requirements.

In the case of substantial changes that have a direct impact on subscribers, prior notification will be sent to them via their client area or any other appropriate communication channel.

The subscriber acknowledges and agrees that continued use of the services after the modifications take effect constitutes implicit acceptance of the new applicable pricing conditions.

6. Refund and Cancellation Policy

6.1. Refund Policy

Due to the immediate and intangible nature of the services provided, no refunds will be granted after the activation of the trial period or the renewal of the subscription.

Payments made, including for partially used periods, are final and non-refundable.

6.2. Waiver of the Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code and the Consumer Contracts Regulations 2013, the user explicitly waives their right of withdrawal under the following conditions:

Once the cancellation is confirmed, no further charges will be made after the current billing period.

6.3.2. Responsibility for Cancellation

• The cancellation must be made before the end of the trial period or the current subscription period.
• It is the client’s responsibility to carry out this process on time.
• No cancellation requests by email or other means will be considered valid.
• Any request sent by email will be treated as a support request and not as an official cancellation.

6.3.3. Limitation of Liability

ReversePro.io cannot be held responsible in the following cases:

• Inability for the client to log in to their account or cancel within the deadline due to technical or personal issues specific to the client.
• In case of doubt or technical problems, the client is invited to contact customer support before the end of their trial period or current subscription.

6.3.4. No Retroactive Cancellations

Once the trial period or the current subscription period has been renewed, no refunds will be made for late cancellation requests.

7. Liability and Warranty

7.1. Limitation of Liability

To the fullest extent permitted by applicable law, our liability is strictly limited to the obligations expressly defined in these Terms and Conditions of Sale (TCS). In particular:

7.4. Exclusion of Warranties

The services offered are intangible digital services subject to specific technical constraints. Therefore:

• No express or implied warranty is provided regarding the suitability of the services for the user’s specific needs or the achievement of a particular result.
• We shal not be held responsible for any consequences resulting from misuse of the services by the client.

8. User Content

8.1. User Contributions

The user may contribute to the service by submitting messages, comments, or information via email, contact forms, or any other means of communication.

By submitting content, the user grants ReversePro.io:

• A worldwide, non-exclusive, royalty-free, transferable, and sublicensable license allowing the use, reproduction, modification, adaptation, publication, distribution, and display of such content for any purposes necessary to operate, improve, or promote the services.

The user guarantees that the content provided:

• Does not violate any third-party rights (copyright, trademark, privacy, etc.);
• Is lawful and free from offensive, defamatory, fraudulent, illegal, or harmful content;

8.2. Moderation Rights

You agree to indemnify, defend, and hold harmless TSS Ltd, its officers, employees, partners, and service providers from and against any claims, actions, losses, damages, costs, or expenses (including reasonable legal fees) arising from:

14. Amendments and Severability

• Representing a group of clients or acting as a representative in a class action;
• Participating in consolidated or collective arbitrations.

Each dispute will be handled on a case-by-case basis, ensuring individual treatment.

15.3. Preferential Individual Arbitration

To the extent permitted by applicable law, any dispute between the client and our company shall be submitted to individual arbitration.

• The arbitration will be conducted confidentially, and decisions will be binding only between the involved parties.
• No collective or consolidated arbitration will be permitted.

15.4. Limited Exceptions

In jurisdictions where class action waivers are prohibited by local mandatory laws:

• (a) The dispute shall, to the extent possible, be handled individually, even if class actions are allowed.
• (b) The invalidity of the class action waiver in one jurisdiction does not affect its validity in other jurisdictions where it is legal.
